What will happen to the family home?  Will I be able to pay the mortgage?  Will I have enough to live on? What about pensions? Will I lose everything?

Sorting out the financial problems after divorce or separation or the ending of a civil partnership requires expertise, experience and efficiency.

"we are able to negotiate a settlement of the financial issues in most cases"

Expertise is key. There are a number of areas of law and practice that must be understood by the lawyer, since not only must family legislation and case-law be understood, but property, trust, company, insolvency and pension law may be relevant to some cases.

Experience is vital. Judges have a wide discretion when dealing with settlements following the ending of a marriage or civil partnership.

An experienced professional will be able to identify the range of options within which a judge might decide a case, and will be able to use that knowledge to negotiate an agreement in most situations.

Where it is not possible to reach agreement, the experienced divorce law specialist will be able to advise upon offers to settle, and will ensure that all relevant factors have been investigated and prepared before a case comes on to trial.

Efficiency is essential. Its absence causes delay and increases cost.   Prompt and timely action can save costs, as can choosing the right way to negotiate agreement.

Very few of our cases are decided by judges. We consider it far better if the cost of final hearings and the uncertainty of trial can be avoided through negotiated agreements. We would not encourage a client to take a case to a final hearing unless we were confident of a successful outcome.

The possibility of Alternative Dispute Resolution is always considered. We offer a family mediation service dealing with divorce settlements.   Paul Kemp is a trained Collaborative Family Practitioner .    Links have also been developed with experts in fields such as accountancy, pensions, mortgages, finance and insurance.

Paul Kemp is a Resolution accredited specialist family lawyer with particular specialism in Advanced Financial Provision and Advocacy for Financial Provision.
