Children and Family Breakdown
The courts usually only become involved in the plans made for children where it is necessary to do so to protect them, or where their parents cannot agree upon plans for them.

In those circumstances, the courts can make orders as to:

  • who a child should live with – usually known as child custody or residence;
  • what contact he or she should have with parents and others – sometimes known as child access;
  • whether specific steps should be taken for the child; and
  • Whether anyone should be prohibited from doing something with regard to the child.
    "it is always understood that the best interests of children must be put first"

The court has other powers to protect children.

For the family lawyer at The Worcester Family Law Practice it is always understood that the best interests of the child must be put first.

This does sometimes mean giving unwelcome advice to clients. Those who follow such advice rarely regret doing so.

Equally, there are times when firm and timely action must be taken on behalf of a parent to protect the interests of a child.

Parents may also choose to deal with issues affecting children through family mediation or collaborative family law.

Children at Risk (Care Proceedings)
Few events can be as traumatic for a parent as to find themselves at the centre of allegations that their child has been abused or neglected. A child may be removed by local authority or police using emergency powers. In such circumstances, early legal advice and help is essential. The Worcester Family Law Practice is able to assist parents through the process of social work investigation and court proceedings.

Adoption
Whether following care proceedings, or within a new family unit, the process of adoption is one strewn with pitfalls. The Worcester Family Law Practice is able to guide applicants for adoption or parents seeking to challenge an adoption application.
