Child Support has had a poor press - much of it deserved. The system was established to provide a simple and inexpensive way of deciding what contribution should be made for children by their non-resident parents, and then to collect the payments, but the Agency is generally considered to have largely failed both parents and children.

Many parents prefer to deal with these matters by agreement, and for them the Child Support formula provides a useful starting point for their discussions. The Worcester Family Law Practice solicitors are able to calculate liabilities in most circumstances.

Parents in receipt of some state benefits (such as Income Support) and those who cannot reach agreement are forced to use the Child Support Agency.

The Child Support Agency cannot deal with some cases (such as where one parent lives abroad), and the Court may be asked to fix child support levels in these circumstances.

Where divorcing parents agree maintenance provision for their children, their agreement can be incorporated into a consent order.  Such orders exclude the possibility of a later application to the Child Support Agency, but only for a period of 12 months.

The Court may also award top-up maintenance in excess of the Child Support Agency's maximum, and can make orders for payment of school fees.
